BEYOND GUANTÁNAMO: RESTORING THE RULE OF LAW TO THE LAW OF WAR

Our project sought to add factual updates and legal scholarship to the University of Pennsylvania Center for Ethics and the Rule of Law's 2021 report titled "Beyond Guantanamo: Restoring the Rule of Law to the Law of War." As described by Major General John D. Altenburg Jr., the Report constitutes "the product of a concerted effort by the Center for Ethics and the Rule of Law affiliated with the Annenberg Public Policy Center of the University of Pennsylvania to bring together diverse experts to analyze several issues and concerns directly related to GTMO, including detention authority, detainee treatment, interrogation policy, options for imposing criminal accountability (to include military commissions and courts-martial), incarceration options, and related human rights and fiscal concerns." Our updates primarily concerned identifying international standards for legal detention, identifying illegal acts committed by the United States with respect to indefinite detention, and analyzing the policy roadblocks that prevent the closure of the facility.
